‘Screwed’ Homeowner To Face Fines; Filing Lawsuit

David Bowden, whose now well-known house declared in paint that he's been "Screwed By The Town Of Cary" has only a few hours until he will start facing fines from the town.

Officials say if the sign isn't removed by midnight Friday morning, they will start enforcing the town's sign ordinance. 

They're threatening to charge him $100 Friday, then $250 if it's not down after a three-day waiting period and eventually $500 every day after that.

Bowden said he has no intention of removing the sign until Cary agrees to buy his house.  He contends that roadwork along Maynard Road has ruined the building, and that the town should be held responsible.

"I couldn't get the Town of Cary's attention until I put the sign up. If I take the sign down, the attention's gone," said Bowden.  "All they want to do is get the sign down; they're not worried about my house."

Instead, Bowden and the American Civil Liberties Union filed the lawsuit Thursday.

The lawsuit asks the Court to declare the Cary sign ordinance unconstitutional and to issue a temporary restraining order and an injunction against the Town, preventing the ordinance from being enforced against Bowden.

The suit claims the town is trying to silence free speech.

Town officials say the size and color of the sign -- not the message itself -- is what they have a problem with.

    Yes John, Hail our government overlords they couldn't possibly be in the wrong. I find it incredible there are people who mindlessly believe/follow everything the government says. Good for the homeowner for standing up for himself.

    The City of Cary has made every effort to work things out. This guy is just looking for a free ride and a handout to unload a house he no longer wants to pay for. He could very easily get the city to make the changes, but he is sticking firm and he just wants them to buy his house. Give me a break, this is just wasting money the city doesn't have. Either sell the house and move or pay your bills.

    This man can't be this stupid? Will the American Civil Liberties Union pay any fine accrued while his suit wines it way through the courts for years if he loses?
