A Raleigh developer is taking WalMart to court after the retail giant decided not to build a store in southeast Raleigh.
WalMart had planned to build at the intersection of Rock Quarry and Sunnybrooks roads.
The City Council approved the deal three years ago.
Under a joint development agreement with Granite Development LLC, WalMart was supposed to develop the site and surrounding area.
But WalMart backed out in 2008, citing a decision to cut back on supercenter growth.
Granite is suing to pay for sitework on the land. According to the suit, it suffered more than $75,000 in damages.
WalMart representatives said the decision not to build was based on a decision to slow down expansion plans and had nothing to do with Granite.
The Southeast Raleigh location is one of four projects across the state that will not move forward.
