Attorneys representing the husband of a murdered Cary woman acknowledge he had an affair, but also allege she had one, too.

Lawyers for Brad Cooper filed several motions related to the custody case involving the children he had with the late Nancy Cooper.
The first motion demands that Alice Stubbs not be allowed to represent Nancy's parents and sister due to a conflict of interest.
Stubbs won an emergency custody order last week for Garry and Donna Rentz, and Nancy's identical twin sister, Krista Lister.
Lawyers concede in the motion that Brad Cooper "had a one-time sexual liaison several years ago."
The motion goes on to argue that plaintiffs will use that information to try and prove that Cooper was a bad father, but allege, "This fact, especially in light of Ms. Cooper's own extramarital encounter, should have no bearing on Mr. Cooper's fitness as a parent."
Brad Cooper's attorneys are also asking for the medical examiner to release Nancy's autopsy records.
The filing says "this information may offer Mr. Cooper a response to Plaintiff's unsubstantiated allegations that he played a role in his wife's death."
A third asks Stubbs to disclose conversations she had with Nancy Cooper prior to her death relating to Brad Cooper's ability to be a good parent.
An emergency child custody order expires Friday and the Rentz and Lister families are due to follow up to that order.
