New Affidavit Filed In Cooper Custody Case

There's a newly filed affidavit in the custody fight over the children of a murdered Cary mother.

In the deposition, Nancy Cooper's friend, Carey Clark, says she never went running with Cooper the morning she disappeared, nor did she have plans to.

Clark gave her statement two weeks ago, before a scheduled custody hearing, but attorney's representing Nancy Cooper's parents and sister didn't file it until Tuesday.

Nancy's husband, Brad Cooper, had said in his affidavit that he believed Nancy had left the house to go running with a friend named "Carrie."

Police have not named a suspect in the case.
